Terms of Sales
As of April 2024
Note – For the purpose of this document Justine Paul at White Shadows Photography might be referred to as “We/Us”. The visitor to the site or the individual (whether representing an organisation or not) who places the order shall be referred to as “Client/You”.
1. Introduction
1.1 These terms and conditions shall govern the sale and purchase of all Products & Services offered by us in-person or remotely.
1.2 By booking a session or ordering a product with us you give your express agreement to these terms and conditions.
1.3 These terms and conditions do not affect any statutory rights you may have as a consumer.
2. Applicable law
2.1 The laws of England and Wales shall govern this agreement. These Terms and Conditions shall not be varied except by agreement in writing.
2.2 In the event of any conflict between these terms and conditions (including those relating to the time of payment) and those issued or submitted by the Client and in the absence of any contrary agreement in writing these Terms and Conditions shall prevail.
3. Bookings and Payments
3.1 Upon the booking fee or full payment, the Photographer shall reserve the time and date agreed upon.
3.2 Booking fees are non-refundable unless the session is cancelled by us. The balance of any event is due on the day of the event. In the event of the delegate needing to cancel, the fee can be transferred to an alternative available date.
3.3 Once the photography package has been chosen and the invoice sent, all payments must be completed within 7 days.
4. Fulfilment of obligations
4.1 We shall not be liable to the Client for any failure, to fulfil its obligations where failure arises because of an event or circumstances beyond its control, which may include (but are not limited to) equipment failure, inclement weather, illness, or injury.
4.2 Due to the vagaries of weather and the willingness of subjects it may not be possible to capture all the pictures requested, or images to the client’s full expectations. In the event of uncooperative children at a session of any kind, for any reason, we may not be able to capture any, or all the images the Client may have requested or expected. The Client is responsible for all children at all sessions.
4.3 In the unlikely event of total photographic failure or cancellation of the contract by either party or in any other circumstances the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential losses.
4.4 If the Client arrives for their shoot on the incorrect date, we will not be responsible for any charges incurred by the Client and the Client will not be entitled to a refund.
4.5 If Client is more than 30 minutes late for a session without communication the session will be cancelled, and no refund of your deposit will be given. A full deposit fee will need to be paid to rebook.
5. Image production and handling
5.1 We fully edit all images before presenting to Client. Additional edits are carried out at our discretion, and we reserve the right to charge the Client for additional editing to cover time involved, at a rate of £15 per image. Any additional edit requests MUST be raised by Client before the delivery of their gallery.
5.2 Clients receive high resolution edited jpg images. Raw files are never provided to the client.
5.3 If the Client does not view or purchase images within two months of the session without arrangement, we will assume they are not wanted and will delete all files.
5.4 If the Client loses or damages his or her digital images, we will not by liable for such loss or damage and will not replace lost or damaged files. It is highly recommended clients immediately back-up any digital files on an external drive or via online cloud storage. Digital images purchased by the Client remain the property of White Shadows Photography and may not be altered in any way, shape of form, including but not limited to editing the overall style of image, colour/contrast/exposure changes, cropping portions of the images, adding objects/persons/graphics, and deleting objects/persons/graphics.
6. Online Galleries
6.1 Preview images are chosen at the discretion of White Shadows Photography.
6.2 Online galleries will be live for 1 month. All orders must be decided during this time.
6.3 The first reopening of online galleries will incur an admin charge of £10 per week.
6.4 It is illegal to attempt to download, or to attempt to remove a watermark from, any image taken and posted online by us for any reason. Should an image online be saved via any means, and used elsewhere without our written permission whether the copyright has been removed or not, a copyright infringement fee of £1000 per image will be applied to avoid court action and must be paid within 28 days.
7. Order and delivery
7.1 Your order should be available to collect from White Shadows Photography within 10 days of:
a) your order being accepted AND
b) full cleared payment being received by White Shadows Photography.
7.2 All order collections must be made via a pre-arranged appointment with us.
7.3 In some circumstances, we may arrange to make a delivery of your order directly to you ( to the UK Mainland ONLY).
7.4 Any charges incurred by us in making a delivery directly to you including, without limitation, courier and postage fees, will be added to your order.
8. Camera policy
Cameras and camcorders is NOT permitted during any session, either in the studio or on location. Phones might be used at the discretion of White Shadows Photography..
9. Privacy policy
We will never share, allow to be accessed or distribute any personal or contact information of any client or enquiry obtained by any means. ALL contact information is protected on secure systems. FOR FULL PRIVACY POLICY STATEMENT SEE HERE.
10. Image viewing and printing
All images we produced are done on a fully calibrated monitor, and all prints will be a true reflection of the editing carried out by us. We will not be held responsible for variances in images caused by clients viewing images on non-calibrated screens or monitors.
11. Prices
All prices are subject to change without notice by White Shadows Photography, but it will not affect contracts that have previously taken into force.
12. Returns policy
12.1 Incorrectly supplied items and items of poor quality can be returned within 7 days and will be replaced at no extra charge to the Client.
12.2 Faulty items should be posted to Justine Paul at White Shadows Photography, 42 Trunley Way, Hawkinge, Kent, CT18 7SD. The Client is responsible for any costs associated with return postage.
12.3 Returns will not be considered for incorrectly ordered items or items ordered in error.
12.4 No return, exchange or refund is available on any item once the image proof has been approved, and an order placed.
13. Gift vouchers
13.1 Gift vouchers purchased from us are only valid for 12 months from date of purchase.
13.2 Gift vouchers cannot be exchanged for cash and are non-transferable. No refunds will be given.
IMAGES ARE KEPT FOR A 12-MONTH PERIOD AT THE DISCRETION OF WHITE SHADOWS PHOTOGRAPHY.
